Aurora Home Lights - Terms and Conditions of Acceptance
By accepting this agreement, the customer (referred to as "Customer" or "you") agrees to the following terms and conditions for the installation of permanent LED lighting by Aurora Lighting Co. (referred to as "we," "us," or "Aurora Lighting Co."):
1. Scope of Work
Aurora Lighting Co. agrees to install permanent LED lighting at the address provided by the Customer ("Job Site") in accordance with the specifications discussed and agreed upon before the installation.
Any changes or additional work requested by the Customer outside of the agreed-upon scope will require a new written agreement and may incur additional charges.
2. Pricing and Payment
The total price for the installation is specified in the agreement, based on the scope of work. Deposit (half of the fee) is due before commencement of work. The final balance is due within 7 days of completion of work. The Customer agrees to pay all charges promptly. Late payments may incur additional fees or delays.
In the event that the Customer cancels the job after materials are ordered or work has commenced, the Customer may be subject to cancellation fees, including but not limited to the cost of materials and labor already incurred.
3. Customer Responsibilities
The Customer is responsible for ensuring that the installation area is accessible and clear of obstructions. The Customer must inform Aurora Lighting Co. of any conditions that may affect the installation, such as electrical issues or structural concerns.
4. Scheduling and Delays
Aurora Lighting Co. will make every effort to complete the work within the scheduled time frame. However, the Customer understands that unforeseen delays (weather, unforseen modifications, supply chain issues, etc.) may occur. If additional work or unforeseen complications arise during installation, the Customer will be notified, and any delays will be communicated promptly.
5. Warranty
Aurora Lighting Co. provides a 1 year warranty on all LED lighting installations against manufacturing defects and workmanship errors.
The warranty does not cover damage caused by external factors such as electrical surges, misuse, accidents, extreme nature events, or failure to maintain the system. Any warranty claims must be made in writing and may require an inspection or documentation of the issue.
6. Installation Process
The installation of LED lighting will be performed in accordance with industry standards and safety regulations. All installations will be done professionally and with due care.
The Customer acknowledges that the installation involves electrical work, and Aurora Lighting Co. will ensure that all work complies with local codes and standards.
The Customer acknowledges that as part of the installation process, modifications may be made to the exterior of the property, including but not limited to drilling, wiring, and affixing fixtures necessary for the permanent LED lighting installation. Every effort will be made to minimize disruption, but the Customer understands that some structural alterations may be necessary and will be done professionally. Any significant changes will be communicated in advance and agreed upon.
7. Liability
Aurora Lighting Co. will not be held liable for damages to property that are beyond the scope of the agreed-upon installation (e.g., damage to property due to pre-existing electrical conditions or unexpected issues encountered during installation). The Customer agrees to hold Aurora Lighting Co. harmless from any claims arising from improper use or failure to follow product instructions after installation.
8. Right to Terminate
Aurora Lighting Co. reserves the right to terminate this agreement if there are violations of these terms, including non-payment, obstruction of work, or unsafe working conditions.
In the event of termination, the Customer agrees to pay for all work completed up until that point.
9. Governing Law
This agreement is governed by the laws of Arizona. Any legal disputes will be subject to the jurisdiction of the courts in Arizona.
10. Acceptance
By accepting this agreement, the Customer acknowledges that they have read, understood, and agree to the terms and conditions set forth above.
Any modifications to this agreement must be made in writing and signed by both parties.•
